By accessing or using BrainVault, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our service.

Your Account

You are responsible for maintaining the security of your account and password. BrainVault cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.

What You Own

All memories, notes, files, conversations, and any other content you add to BrainVault belong to you. We do not claim ownership of your data. You grant us a limited license solely to host, store, and process it for the purpose of providing the service.

What We Own

The BrainVault platform, including its software, AI systems, design, branding, trademarks, and underlying technology, is the property of TransactBridge LLC and is protected by intellectual property laws.

Acceptable Use

• No illegal, harmful, or abusive content.
• No spam, harassment, or unauthorized data scraping.
• No reverse engineering, decompiling, or attempting to extract our source code.
• No activity that disrupts or interferes with the service.

Business Accounts

Company administrators agree to use employee data responsibly and in compliance with all applicable privacy and employment laws. You are responsible for obtaining any necessary consents from employees before adding them to a Business account.

AI-generated responses, summaries, and suggestions are for informational purposes only. They do not constitute professional advice (legal, medical, financial, or otherwise). Always verify critical information independently.

Payments & Billing

Subscription billing is handled via Stripe. You can cancel your subscription at any time from your account settings. No refunds are provided for already-used billing periods. Upgrades take effect immediately; downgrades take effect at the next billing cycle.

Termination

We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent or abusive behavior. You may delete your account at any time. Upon termination, your data will be deleted in accordance with our Privacy Policy.

Limitation of Liability

In no event shall TransactBridge LLC, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of BrainVault. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State in which TransactBridge LLC is registered, United States, without regard to its conflict of law provisions.
